EDITOR'S NOTE: Update on OIS that occurred inside an accelerating van

 

In the last edition of Force Science News, we reported on a federal civil rights case that involved an officer who shot and killed a driver who had trapped him inside a speeding van. As we stated, a three-judge panel of the 9th Circuit U.S. Court of Appeals upheld a lower court's decision of summary judgment favoring the defendant officer and his city, Anaheim, CA.

 

The plaintiffs--surviving relatives of the suspect, who sued on a claim of excessive force--have petitioned for and received a review of that decision by all the court's 11 justices, sitting in San Francisco. Oral arguments have been made and can be viewed on a video posted on the court's website. Arguing the case on behalf of the defendants was Moses Johnson, an Anaheim assistant city attorney with some 20 years' experience and a subscriber of Force Science News. The court's decision, he told FSN, "could be months away." We'll keep you posted.
